The Integrity Reporting Services Agency (“the Agency”) owns the rights to, and operates, the www.irsa.mu domain name and website.

This page informs you of the Agency’s policies regarding the collection, use, processing and disclosure of personal data and information when you use this website, and the choices you have regarding such personal data and information.

This page also informs you of the Agency’s duties and obligations, as well as yours, when you choose to report or disclose any matter or information to the Agency using this website.

By accessing and using this website, you consent to the stipulations of this Confidentiality and Privacy Policy, including the collection, processing and use by the Agency of data and information in accordance with the terms thereof.

IMPORTANT INFORMATION ABOUT THE AGENCY AND DISCLOSURE OF INFORMATION

The Agency is set up under the Good Governance and Integrity Reporting Act 2015 (“the Act”) which came into force in the Republic of Mauritius since 10th December 2015. The Act empowers the Agency to receive reports and disclosures of positive acts of good governance and integrity, acts of malpractices and unexplained wealth, and to evaluate and process any such report or disclosure.

The Agency will not investigate property which has been acquired or has come into the possession or under the custody or control of a person more than seven years prior to the report or other disclosure of information made to the Agency concerning such property.

The Agency is empowered to investigate into unexplained wealth and can confiscate unexplained wealth of at least 10 million rupees, which includes any property

  1. under the ownership of a person to an extent which is disproportionate to his emoluments and other income;
  2. the ownership, possession, custody or control of which cannot be satisfactorily accounted for by the person who owns, possesses, has custody or control of the property; or
  3. held by a person for another person to an extent which is disproportionate to the emoluments or other income of that other person.

Reports or disclosures of information can be made to the Agency by any person. The information provided above is meant to assist you in determining whether any report or other disclosure of information you may wish to make is relevant and falls within the scope of the Agency’s duties, powers and functions under the Act.

CONFIDENTIALITY OF REPORTS AND DISCLOSURES OF INFORMATION

If you are aware of information which falls within the scope of the Agency’s duties, powers and functions under the Act, you can opt to make a disclosure or report to the Agency by using this website.

The Agency does not accept, and cannot act upon, anonymous reports or disclosures of information via this website. If you wish to make a report or other disclosure of information via this website, you will have to fill in the designated form(s) on either the Report Page or the Contact Us page of this website. In either of these forms, you will be required to provide personal details which can be used by the Agency to identify you and contact you if need be. These personal details include your full name, address, phone number and email address. When submitting such personal data as part of the report or other disclosure, you will be required to confirm on the relevant page that you have read and agreed to the terms of this Confidentiality and Privacy Policy.

The Agency, its officers and service providers operate and are bound under strict confidentiality provisions under the Act. When you make a report or other disclosure of information to the Agency, the source of the information reported or disclosed to the Agency, including your identity or any personal details provided by you, will be kept strictly confidential at the level of the Agency and shall not be disclosed to any person, unless such disclosure is in the interests of the prevention and detection of crime or unless otherwise required by law or by virtue of a court order.

Any report or other disclosure of information which you make to the Agency must be genuine, or you must at least have reasonable grounds to believe that the information you are disclosing to the Agency is true at the time of disclosure, and of such nature as to warrant an enquiry by the Agency.

The Agency, when enquiring into the report or other disclosure of information made by you, is empowered to consider and determine whether your report or other disclosure of information is genuine or based on a reasonable belief of the truth of the information disclosed. Any person who knowingly makes a false, malicious or vexatious disclosure to the Agency shall commit an offence and is liable to a fine not exceeding 50,000 rupees and to imprisonment for a term not exceeding one year.

It is also an offence for any person to victimise, or retaliate against, any person who has made a report or other disclosure of information to the Agency. The Act therefore protects you against any act which is consequential to any report or other disclosure of information made by you to the Agency and which causes you injury, damage or loss, which is an act of intimidation or harassment against you, which is an act of discrimination, disadvantage or adverse treatment in relation to your employment or which amounts to threats of reprisals.

The personal data provided by you to the Agency when making a report or other disclosure of information shall only be kept by the Agency, or any service provider processing data on its behalf, for as long as is reasonably required. Any personal data provided by you to the Agency shall be destroyed as soon as reasonably practicable after it is no longer required.

PRIVACY OF BROWSING DATA

When you use this website, Browsing Data in the form of Usage Data and Tracking & Cookies Data will be gathered.

Usage Data is information that your web browser sends whenever you access this website by or through a computer, mobile or other electronic device.

Tracking & Cookies Data refer to cookies and similar tracking technologies which are used to track the activity on this website and hold certain information.

TRANSFER OF DATA AND SECURITY

The Agency may contract with third party companies and individuals (“Service Providers”) to facilitate this website, to provide this website on behalf of the Agency, to perform services associated with this website or to assist the Agency in analysing how this website is used.

In order to enable such Service Providers to perform their contracted duties and functions on behalf of the Agency, the Service Providers may require access to the data provided by you to the Agency or generated by your use of this website, and may have to store, albeit temporarily, such data on systems owned and/or operated by them.

The Service Providers, including their officers, agents and/or other préposés, are bound, in their treatment, use, access, processing or storage of the data, by strict confidentiality and non-disclosure obligations, and in particular are not authorised to make use of or disclose any such data other than for the purposes for which their services have been retained by the Agency, save for any disclosure as may be authorised by law or a court of competent jurisdiction.

The Browsing Data generated from your use of this website may be transferred to, processed and/or backed up by third party Service Providers located outside the Republic of Mauritius and accordingly maintained on computers located outside of the Republic of Mauritius. Such third party processing is carried out under strict confidentiality and non-disclosure obligations and subject to documented privacy and security policies.

If you are located outside Mauritius and choose to provide information to the Agency via this website, please note that the Agency receives the data, including personal data, in the Republic of Mauritius and processes it within the latter jurisdiction.

Your consent to this Confidentiality and Privacy Policy, followed by your submission of such information to the Agency, constitutes your consent and agreement to this transfer of information or data to the jurisdiction within which the Agency operates, i.e. the Republic of Mauritius, and is accordingly subject to the laws of the Republic of Mauritius.

The Agency will take all steps reasonably necessary to ensure that your personal data is treated securely in accordance with this Confidentiality and Privacy Policy Statement and that no transfer of your personal data will take place to any organisation or country unless there are adequate controls in place to reasonably ensure the security of your data and other personal information.

The security of your data is important to the Agency, and the Agency has implemented reasonable and appropriate internal security and organisational measures for the prevention of unauthorised access to, the alteration of, the disclosure of, the accidental loss of and the destruction of data in its control. The Agency also only contracts with third party Service Providers represented to be making use of reasonable and appropriate security technologies and measures designed to protect information from unauthorised access, use or disclosure.

However, no method of transmission over the internet, or method of electronic storage, is 100% secure. While the Agency and its Service Providers make use of reasonable and appropriate means to protect your personal data, the Agency and its Service Providers cannot guarantee its absolute security against the risks reasonably associated with the use of the internet, electronic means of data transmission and the use of Information and Communication Technology generally.

By accessing this website and/or by providing or disclosing personal data to the Agency via this website, you accept the risks associated with data and information transmitted or disclosed via the internet or electronic means and you absolve the Agency of any and all liability for any loss, damage or risk associated with such transmission of data.

CHANGES TO THIS PRIVACY POLICY

The Agency may update this Confidentiality and Privacy Policy from time to time. The Agency will notify you of any changes by publishing the updated Confidentiality and Privacy Policy on this page of this website.

The Agency will inform you of the update via a prominent notice on this website, prior to the update becoming effective. The “Effective Date” at the top of this Confidentiality and Privacy Policy shall be amended accordingly.

You are advised to review this Confidentiality and Privacy Policy periodically for any changes. Changes to this Confidentiality and Privacy Policy are effective from the moment they have been published on this page of this website and there has been notification of the change on this website.
